1. Introduction

Welcome to Code Red Medical Couriers LLC (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern the use of our website, https://coderedmedicalcouriers.com/ (the “Site”) and our specialized courier and logistics services (the “Services”) provided to healthcare, government, and laboratory clients.

By using our Site or Services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our Services.

 

2. Scope of Services

Code Red Medical Couriers LLC provides secure, compliant, and time-critical courier services for:

  • Hospitals, clinics, laboratories, and pharmacies
  • Department of Defense (DoD), Veterans Affairs (VA), and federal healthcare facilities
  • Public health departments and government agencies
  • Private diagnostic and clinical research organizations

Services include (but are not limited to):

  • Specimen and sample transport
  • Medical equipment, pharmaceutical, and vaccine delivery
  • Prescription and controlled substance logistics (as authorized)
  • Chain-of-custody couriering for legal, clinical, or forensic samples
  • Scheduled and on-demand route services

All materials are handled according to applicable federal, state, and institutional standards.

 

3. Regulatory Compliance

Code Red Medical Couriers LLC complies with the following standards and regulations:

  • HIPAA (45 CFR Parts 160 & 164) — Health Information Privacy & Security
  • OSHA 29 CFR 1910.1030 — Bloodborne Pathogens & Biohazard Handling

4. Service Level Agreement (SLA)

4.1 Delivery Types

  • Routine Service: Within 2–4 hours of pickup.
  • Stat/Emergency Service: Typically, within 60–90 minutes depending on distance.
  • Scheduled Routes: Fixed recurring routes per service agreement.

 

4.2 Proof of Delivery (POD)

Each delivery includes timestamped pickup and delivery records with:

  • Electronic or physical signature
  • Barcode/QR tracking
  • Optional temperature and condition verification

 

4.3 Chain-of-Custody (COC)

All shipments requiring custody control (e.g., biological samples, forensic materials) are documented via electronic or paper COC logs detailing:

  • Courier ID
  • Pickup/transfer/drop-off timestamps
  • Seal verification numbers
  • Authorized signatures

 

4.4 Temperature Control

Validated insulated containers and temperature monitoring devices are used for specimens requiring cold chain or ambient control. Logs available upon request.

 

4.5 Notification & Performance

Clients receive real-time tracking, exception alerts, and delivery verification. Monthly or quarterly service performance reports may be provided upon request.

 

5. Fees and Payment

Rates and payment terms are outlined in your executed contract, purchase order, or rate schedule. Invoices are due per agreed terms. Late payments may result in service suspension or interest charges.

All fees are in U.S. dollars unless otherwise specified.

 

6. Confidentiality and Data Protection

Code Red Medical Couriers LLC ensures that all couriers and staff receive HIPAA, OSHA, and privacy training. Confidential data, including patient information, lab results, or agency records, is safeguarded at all times through encryption, access control, and secure transmission methods.

We will not disclose client or patient data except as required by law or authorized by contract.

 

7. Insurance and Liability

Code Red Medical Couriers LLC maintains:

  • Commercial General Liability Insurance
  • Automobile Liability Insurance
  • Cargo/Transit Insurance
  • Workers’ Compensation (per South Carolina law)
  • Professional Liability / Errors & Omissions coverage

Our liability for loss, damage, or delay is limited to the lesser of the shipment’s declared value or the amount paid for the specific delivery, unless otherwise provided by written agreement.

 

8. Government & Institutional Clients

When contracting with U.S. government or state agencies:

  • Code Red Medical Couriers LLC agrees to comply with all applicable FAR, DFARS, and Federal Supply Schedule requirements.
  • Equal Employment Opportunity (EEO), Affirmative Action, and non-discrimination clauses (per Executive Orders 11246, 13496, and 13665) apply.
  • Government clients retain rights consistent with applicable procurement laws.
  • Code Red Medical Couriers LLC maintains current SAM.gov registration, UEI number, and applicable NAICS codes for courier and logistics services.

 

9. Chain-of-Custody Policy

  1. Each item transported receives a unique identifier.
  2. Couriers verify the integrity of packaging and seals at each custody transfer.
  3. Chain-of-custody logs are completed and signed at each exchange point.
  4. Secure vehicles are used for sensitive materials; GPS tracking is active during transport.
  5. Any incident of breakage, temperature deviation, or delay is reported immediately to the client.

This policy complies with CAP, CLIA, and DoD lab transport standards.

 

10. HIPAA Business Associate Agreement (BAA)

As a Business Associate under HIPAA, Code Red Medical Couriers LLC agrees to:

  1. Safeguard Protected Health Information (PHI) per 45 CFR §164.502(e).
  2. Limit Use and Disclosure to purposes necessary for transport and delivery.
  3. Report Breaches or Unauthorized Disclosures within ten (10) business days of discovery.
  4. Require Subcontractors handling PHI to comply with equivalent protections.
  5. Return or Destroy PHI upon termination of the agreement when feasible.
  6. Permit Audits by client or authorized government bodies to verify compliance.

Both parties agree that failure to comply with HIPAA requirements constitutes a material breach of this Agreement.

 

11. Security & Personnel Vetting

All employees and contractors:

  • Undergo background checks, drug screening, and driver’s license verification.
  • Receive annual HIPAA and OSHA training.
  • Are issued photo identification badges and uniforms.
  • Use secure GPS-tracked vehicles and chain-of-custody seals.

Additional security requirements (e.g., DoD clearance) will be met as required by specific contracts.

 

12. Intellectual Property

All content, trademarks, and materials on our Site or within our software systems are owned by Code Red Medical Couriers LLC. Unauthorized use, reproduction, or distribution is prohibited.

 

13. Termination

Code Red Medical Couriers LLC may terminate or suspend Services for violation of these Terms or legal noncompliance. Termination procedures for government contracts will follow FAR/DFARS requirements or the applicable service agreement.

 

14. Governing Law

These Terms are governed by the laws of the State of South Carolina. Jurisdiction for disputes shall lie in Richland County, South Carolina, unless otherwise required by federal procurement law.

 

15. Modifications

We may amend these Terms to reflect legal, regulatory, or operational changes. Updates take effect upon posting. Continued use of Services constitutes acceptance of the revised Terms.

Acknowledgement

By using Code Red Medical Couriers LLC Services, the Client acknowledges they have read, understood, and agree to these Terms & Conditions, including all incorporated compliance and security provisions.
